Course objectives

URBAN PLANNING LAW The course deals with the most relevant legislative acts and decisions in urban planning and building laws. Classes are based on case studies, with specific regard to EU law. The course also examines environmental international and national norms. It aims at providing the students with a legal background in the field of urban planning.

Course program
Plan Part I - Introductory notions • Sources of law. • The division of functions between territorial entities:  the regulatory functions with particular regard to the subjects of environmental protection and cultural heritage, the relative valorisation, the government of the territory.  Administrative functions between the principle of subsidiarity and the level of interests • General profiles of the administrative organization. • Administrative law and the notion of public administration • General administrative acts and planning acts • Punctual deeds: the administrative provision and its discipline • The administrative procedure between general law and sector regulations • Inertia of the administration and institutions of simplification: silent assent • Liberalizations: the Scia • Multi-structured proceedings, the conference of services and the protection of "sensitive interests" Part II – Territorial and urban planning • The evolution of urban planning law: historical profiles. • The general planning system • Wide area planning • Sector planning to protect differentiated interests and compliance constraints. • Coordinating institutes. • The master plan.  Zoning, urban standards and reform prospects for the creation of the "public city".  Location: Urban constraints and safeguard measures. • Implementation planning between unilateralism and consensus. Part III - Urban regeneration policies and consensual urban planning • The "right to the city" in the multilevel perspective of the legal system • Urban regeneration policies between national disciplines and regional legislation. • Integrated plans, special programs and consensual urban planning. • Towards a procedural conception of the general urban planning tool • Equalization instruments and compensatory institutions. The extraordinary contribution between administrative practices, administrative jurisprudence and positions of the constitutional judge. Part IV - Building activity and compulsory purchase of land. • The historical evolution of the regulation of private building activity. • Building activities and building permits in the TEU: d.P.R. no. 380/2001, according to the most recent reforms. The agreed building permit. • The constitutional protection of private property, compulsory purchase of land and related institutions.
Prerequisites
A general knowledge of the Italian and European legal systems is recommended. No prerequisites required

Organization and Relationships, latest edition, Turin (to be supplemented with materials on the system of legal sources and general administrative law) or M. Carrà, W. Gasparri, C. Marzuoli, Land Management Law, latest edition (to be supplemented with updated materials, with particular emphasis on the regulation of construction activities) Updating and in-depth materials are uploaded to the e-learning platform.
Frequency
Class attendance is optional but highly recommended.
Exam mode
The exam is oral, with questions designed to assess the student's knowledge and critical thinking skills, as well as their mastery of the subject matter. Attending students will take an ongoing written exam, the grade of which will account for 50% of the final grade.

Lesson mode
