Course objectives

objectives This module aims to provide students with the basis of the legal framework of policies for sustainability and environmental protection, with particular regard to the activity of public administration, through the study of European and national legislation and the leading cases of European and national Cousrts. Subject of brief discussion will be in particular the principles relating to administrative discipline to protect the environment in general; the regulations of energy and renewable sources, of waste and water services. Knowledge and understanding To assess, through a critical approach, the conditions and opportunities for sustainable development related to the institutional and regulatory framework.

Course program
From the protection of the landscape to the protection of the environment.  The environment and the safeguarding of the interests of future generations in the 2022 constitutional reform.  The establishment of the Ministry of the Environment and the initial regulation of environmental damage; access to environmental information; the role of environmental associations.  Administrative instruments of environmental protection: planning tools, technical assessments, authorizations, and green public procurement.  The European principles of environmental protection: prevention; remediation of damage at its source; the precautionary principle; the polluter-pays principle.  The circular economy: principles governing waste management and production.  The European Green Deal and the fight against climate change, with reference to sectoral policies: regulation of renewable energies, energy efficiency, and the promotion of green private investments; the “Do No Significant Harm” (DNSH) principle.
