LAW AND INSTITUTIONS OF THE EUROPEAN UNION

Course objectives

The course provides a basic knowledge of costitutional European Union Law. By the end of the course students should be able to understand the institutional and organizational machinery of the EU, the main sources of EU Law and their relations with national law. The specific objective of the discipline include: 1) the knowledge and the comprehension of: a) the european integration process b) the institutional and organizational machinery c) the EU's system of competences d) european sources of law e) relations with internal legal orders f) mechanism of individual protection 2) the ability to apply knowledge and comprehension through the acquisition of skills aimed to analyze and to interpret the activities of the european institutions and the development of EU law. 3) the ability to exercise critical thinking through the solicitation of reflections and discussions on events relating to major topical European issues.

Program - Frequency - Exams

Course program
The course is organized around four main teaching areas: 1) the legal order of the EU (appproximately 4 CFU); 2) judicial and non-judicial protection (approximately 3 CFU); 3) abjectives and competences (approximately 1 CFU); the Italian participation to the integration process (approximately 1 CFU). The first part is organizaed around the following parts: origin and development of european integration; the european legal order; the institutional framework; european sources of law; decision making process. Part two will be about: general aspect on the protection under the EU law; infringement proceedings; action for annulment; preliminary rulings; lower competences; the judicial protection at the national level. Third part will include: objectives and values of the EU; european citizenship; the mechanism of conferred powers. Part four will be about: general aspects on the relations betweenthe eropean and the national order; EU Law and the Italian legal order.
Prerequisites
Even if it is not binding, students should have a basic knowlwdge of Public Law.

Frequency
Attendance is not compulsory, but it is nevertheless recommended, because several group activities will be carried out during the course, which require the active participation of students.
Exam mode
The examination will be oral. Usually, three questions whose answer is about ten minutes for each question.
Lesson mode
Professor will hold face-to-face lectures that will give to students the knowledge described in the part on the aims of the course. Furthermore, taking into account the composition of the class and the intersts showed by students, some seminar or working groups on specific topics may be organized.
